AI's 'Cookie Banner' Moment: EU AI Label Rules Go Live, Forcing Companies to Tag Chatbots and Deepfakes

The European Union's AI labeling rules took effect over the weekend, requiring companies to clearly mark AI-generated images, audio and text that is "designed to look real," the Financial Times reported. The rules are the first compliance wave of the bloc's AI Act and are widely being compared to the cookie-banner moment that swept the web after GDPR.

What the Rules Require

Under the new obligations, companies must ensure that users can tell when they are interacting with a chatbot, watching an AI-generated video, or reading AI-written marketing copy. Labels must be "clear, conspicuous and machine-readable," and the rules cover both B2C and B2B deployments inside the EU, the Guardian added. Penalties for non-compliance scale with the severity of the violation and can reach 7% of global turnover for the most serious breaches.

"AI labels are the new cookie banners. Annoying at first, then normalized," an FT analysis noted.

Who's Already Compliant

Major platforms including Snapchat, YouTube, LinkedIn and Substack have said they are already labeling AI-generated content, the BBC reported. Google has built labeling into Gemini's image and video outputs, and Meta has said its labels will be visible across Facebook, Instagram and Threads. Smaller developers are scrambling: the European Commission has published a compliance template and a dedicated helpdesk for SMEs.

Why It's a Landmark

The labeling rules are the first piece of the AI Act to bite. The next compliance deadlines - covering general-purpose AI (GPAI) providers and high-risk systems - arrive in August 2027. Companies that built labeling into their pipelines early will have a clear head start on those too, the FT noted, and a generation of compliance vendors has already begun marketing "AI label as a service" toolkits.
